Aufhebungsvertrag

A mutual termination agreement between employer and employee, bypassing the standard notice period.

An Aufhebungsvertrag is a mutual agreement to terminate an employment contract. Unlike a regular resignation (Kündigung), it does not require a notice period — both parties agree on an end date.

When it is useful:

  • You want to leave sooner than the notice period allows
  • Your employer offers a severance package (Abfindung)
  • Both parties want a clean, fast separation

Key risk: An Aufhebungsvertrag can trigger a 3-month suspension of unemployment benefits (Sperrzeit) from the Arbeitsagentur. The agency considers it a voluntary job loss.

Important: Always consult a labor lawyer (Fachanwalt für Arbeitsrecht) before signing, especially if a severance payment is involved.
